As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked:

  1. the number of police reports of hate crimes and hate incidents at further education colleges and sixth form colleges in your area for the past five years, broken down by year
  2. the number of arrests that have been made for hate crimes and hate incidents at further education colleges and sixth form colleges in your area for the past five years, broken down by year
  3. the number of convictions that have been made for hate crimes and hate incidents at further education colleges and sixth form colleges in your area for the past five years, broken down by year

After clarity was sought on the time period you confirmed it as 2014 – 2018 incl.

In Response:

We have now had the opportunity to fully consider your request and I provide a response for your attention.

As per our acknowledgment to you on 03/01/20, your request will be aggregated with those received on  02/01/20 from a colleague, FOI 015/20 refers, within your organisation.

As FOI 015/20 has been refused due to cost/time constraints, this automatically means that your request, as it is aggregated due to the cost/time constraints as outlined in our acknowledgement, that Section 12 also applies to this request.

You should consider this to be a refusal notice under Section 17 of the Act for your request.

Your colleague has been advised, under Section 16, what may be provided should they wish to define and resubmit.
