Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')

As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked:

  1. Could you please tell me how many search warrants were made by the force to the courts for each calendar year from 2016 up to the most recent data available.
  2. Could you please tell me how many of these requests were granted and how many were rejected.
  3. Could you please sub-divide this information into which court the requests were submitted to.

In Response:

We have now had the opportunity to fully consider your request and I provide a response for your attention.

Following receipt of your request, searches were conducted within the three Area Commands of Northumbria Police.  I can confirm that the information you have requested is held, in part, by Northumbria Police.

You should note that we cannot guarantee the accuracy of the information provided.  This is because some warrant applications may have been semi–completed and may not have been taken to Court to get authorised as the Officer may feel the threshold for the Magistrate granting the warrant has not yet been met.  Additionally all warrant information will not be held centrally as an officer may apply for their own warrant.  To contact each officer in force to establish if they had applied for a warrant in the 4 year time period requested would far exceed the permitted 18 hour threshold and the request would have been denied under Section 12.  Rather than apply Section 12 to your submission, as a gesture of goodwill we have provided what we have been able to.

With regards to the numbers of warrants rejected, we do not hold this information, on occasion we have to slightly amend a request, usually for a technical reason, but any applications rejected outright are not recorded.

If you decide to write an article / use the enclosed data we would expect that you to take into consideration the factors highlighted above so as not to mislead members of the public or official bodies or misrepresent the relevance of the whole or any part of this disclosed material.
