Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')

As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked:

I am writing to request the following information on trespass related to the use of the Criminal Justice and Public Order Act 1994.

How many times has your Force used the police powers outlined below in each of the following years 2010 – 2019

  1. Trespass on land: directions to leave/remove vehicles - Section 61 Criminal Justice and Public Order Act 1994
  2. Offence of Aggravated Trespass - Section 68 Criminal Justice and Public Order Act 1994 (amended by Section 59 Anti-Social Behaviour Act 2003)
  3. Power to remove persons committing or participating in aggravated trespass - Section 69 Criminal Justice and Public Order Act 1994

Following receipt of your request, searches were conducted with the Corporate Development Department of Northumbria Police.  I can confirm that the information you have requested is held by Northumbria Police.

I am able to disclose the located information to you as follows, with the comments at point 1 noted.

1  Trespass on land: directions to leave/remove vehicles - Section 61 Criminal Justice and Public Order Act 1994.  The description of the offence stated does not match the section stated and instead relates to "Failing to leave land as directed or returning as a trespasser within three months".  The correct section is section 77.  In both cases, there have been no results.
