Unauthorised Encampments Public Consultation - 425/20

Date Responded 25 March 2020

Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')

As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked:

  1. Did your Police Force submit a response to the Home Office public consultation, launched on the 5th of November 2019 "Strengthening police powers to tackle unauthorised encampments"?
  2. If so, can you please provide us with a full e-copy or hard copy of your response to this consultation?

In Response:

As you are now in receipt of your response to your identical submission to the Office of the Police and Crime Commissioner (OPCC) for Northumbria the below exemption applies.

I can confirm what Northumbria Police hold is the same document.

As the information you have requested is accessible by other means I have not provided you with a copy of the information and will rely on Section 21 of the Freedom of Information Act 2000.  You should therefore consider this a refusal for your request.

I have provided an explanation to this exemption below.

Section 21 (1) - Information accessible by other means

Information which is reasonably accessible to the applicant is exempt information.

You have now been provided with your response from the OPCC for Northumbria to your identical request and I can confirm that our response is the same.
