Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')

As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked:

1. The number of fixed penalty notices issued to offenders for using a mobile phone while driving (endorsement code CU80) in your force area in 2015, 2016, 2017 and 2018 to date broken down by month.

2. The total amount of money (£) in fines issued to offenders for using a mobile phone while driving (endorsement code CU80) in your force area in 2015, 2016, 2017 and 2018 to date.

If limited by time constraints, please prioritise questions in order (Q1,Q2).

In Response:

We have now had the opportunity to fully consider your request and I provide a response for your attention. 

Following receipt of your request, searches were conducted with the Fixed Penalty Unit of Northumbria Police. I can confirm that the information you have requested is held by Northumbria Police however cannot be disclosed  for the following reasons.

The information at point 2 cannot be extracted within the time constraints, as this would entail looking at each individual notice to see what the outcome was, for those that were dealt with by courts it would mean further searches on the force system to establish.  This would far exceed the 18 hours.

We have therefore complied with your comment on making point 1 the priority in order to avoid a Section 12 refusal being applied to your whole request.

 I therefore respond to point 1 as below.

 With regards to 2015, 2016 and up to August 2017 the below exemption is applicable.

As the information you have requested is accessible by other means I have not provided you with a copy of the information and will rely on Section 21 of the Freedom of Information Act 2000.  You should therefore consider this a refusal for your request.

 I have provided an explanation to this exemption below.

 Section 21 (1) - Information accessible by other means

Information which is reasonably accessible to the applicant is exempt information.

This information has been asked for previously, released and is published on the Northumbria Police Disclosure Log.  FOI 1054/17 refers and the link to the Log is provided below.
